LAW ON TOURISM<\/a><\/h2>\n

<\/p>\n

The Law on Rent a Car Activities in Serbia<\/strong> consists of Article 101, Article 101 and Article 102. of the Law on Tourism of the Republic of Serbia.<\/p>\n\n

The Law on Rent a Car regulates the rental of vehicles (rent-a-car) in Serbia. It prescribes conditions ( Terms of Use<\/a> ) that rent a car agencies in Serbia must comply with. These conditions for renting a vehicle in Serbia are prescribed by the Law on Tourism, because these and such jobs should be performed by travel agencies.<\/p>\n\n

Law on Tourism of the Republic of Serbia<\/a> (“Official Gazette of the RS”, no. 36\/2009, 88\/2010, 99\/2011 – other laws, 93\/2012 and 84\/2015)<\/p>\n\n

The Law on Rent a Car and the basic provisions of the Law on Tourism (introduction to the Law on Rent a Car)<\/h2>\n\n

1. Subject of arrangement<\/h4>\n\n

Article 1<\/strong>
This law regulates: conditions and method of planning and development of tourism; tourist organizations for the promotion of tourism; tourist agencies; catering activity; nautical activity; hunting tourism activity; services in tourism; tax and penalties in tourism; Register of tourism; other issues of importance for the development and improvement of tourism.<\/p>\n\n

1. Jobs of travel agencies<\/h4>\n\n

Article 43.<\/strong><\/p>\n\n

The tourist agency performs the following tasks:<\/strong><\/p>\n\n

1) organization and implementation of tourist trips in the country and abroad:
1a) organizing and realizing trips of students abroad for the purpose of learning a foreign language or professional development with the possibility of performing temporary and occasional jobs;
1b) offers and sales of tourist trips from point 1) and 1a).
2) offers, sales and mediation in the sale of tourist trips.
3) accepts passenger transportation (transfer).
4) organization of excursions, sightseeing tours, entertainment programs and the like, as well as mediation in the organization of gatherings, fairs, manifestations and sports events.
5) providing, that is, mediation in providing the services of tourist guides, tourist companions, local tourist guides and tourist animators.<\/p>\n\n

The tourist agency performs the following tasks:
<\/strong>
6) obtaining travel documents, booking and selling travel tickets in the name and on behalf of domestic and foreign carriers.
7) reservations and sales of tourist, catering and other services related to the travel and stay of passengers.
8) intermediation in the provision of accommodation and food services in domestic crafts and rural tourism facilities.
9) mediation in the sale of specific tourist services.
10) mediation in renting vehicles to tourists and travelers.
11) reservation and sale of tickets for sports, cultural and other events and manifestations, representation in passenger and luggage insurance in accordance with the law regulating insurance, sale of tourist publications and others.
12) exchange of foreign currency (exchange transactions).
13) other jobs common in tourist traffic.<\/p>\n\n

3. Vehicle rental services (Law on Rent a Car Serbia)<\/h4>\n\n

Article 101.<\/strong><\/p>\n\n

Vehicle rental services (rent-a-car) are considered to be the rental of passenger cars without a driver. A special type of vehicle rental is the rental of passenger cars with driver services (limo service).<\/p>\n\n

Services from para. 1. and 2. of this article can be provided by a business company, another legal entity, an entrepreneur or a branch of a foreign legal entity, if it is registered in the appropriate register.<\/p>\n\n

The association that carries out activities from para. 1. and 2. of this article is obliged to register that activity in the appropriate register. The entrepreneur cannot provide services from para. 1. and 2. of this article during the period of suspension of activities.<\/p>\n\n

If the person from paragraph 3. of this article has a registered activity for the provision of vehicle rental services in the headquarters, but not as a predominant activity, it is required to establish a branch for that activity, i.e. an area outside the business headquarters, which is registered in the appropriate register and recorded in the Tourism Register.<\/p>\n\n

If the person from paragraph 3. of this article offers and sells vehicle rental services in the area outside the headquarters, is obliged to establish a branch, i.e. the area outside the business headquarters, for that activity in each business premises, i.e. the premises outside the business headquarters, which is registered in the appropriate register and recorded in the Register of Tourism.<\/p>\n\n

The service provider is obliged to:<\/h4>\n\n

Article 101.a<\/strong><\/p>\n\n

Service provider from Article 101. article 1. of this law is obliged to:<\/strong>
1) at the entrance to the premises where the activity is carried out, visibly highlight the business name and headquarters;
2) at the entrance to the premises where the activity is carried out, visibly highlight the working hours and adhere to them in their operations.<\/p>\n\n

Service provider from Article 101. st. 1. and 2. of this law is obliged to:<\/strong>
1) in each business premises, i.e. the place of business in which the activity is carried out, he keeps a decision on registration in the appropriate register and a certificate of registration in the Register of Tourism.
2) in each business space, i.e. place of business, to highlight the prices of the services it provides and to adhere to the highlighted, i.e. published prices.
3) issue a prescribed invoice for each service provided.
4) keeps records of services provided.
5) performs activities with the attention of a good businessman.<\/p>\n\n

Records from paragraph 2. point 4) of this article is maintained on a daily basis, according to the principles of orderliness and accuracy, in a way that does not allow the deletion of entered data, which allows viewing the data in chronological order and contains data on the vehicle registration number, data on the driver, the period of use of the vehicle , information about the user of the service, etc.<\/p>\n\n

Article 102.<\/strong><\/p>\n\n

Vehicles that are the subject of rental cannot be older than five years and must meet the conditions established by the regulations on road traffic safety. Provider of vehicle rental services referred to in Article 101. attitude 1. of this law must have at least three registered motor vehicles. Vehicles from Article 101. attitude 2. they can be older than five years.<\/p>\n\n
